Terms of service
This user/customer Agreement (“Agreement”) is made and entered into by and between:
SETU STORE PRIVATE LIMITED, a company incorporated under the Companies Act, 2013, having its registered office at (hereinafter referred to as “SETU”); and
Customer/user of the web portal of the SETU.
Collectively referred to as the “Parties” and individually as a “Party.”
1. Definitions
- Company: Company means SETU STORE PRIVATE LIMITED, a company incorporated under the Companies Act, 2013, having its registered office at DM-01, Noida Sector-104, Greater Noida, Uttra Pradesh, India (hereinafter referred to as “SETU”)
- Buyer: Buyer means and include the person or legal entity, placing an order at the portal of the company.
- Vendor: Vendor means and include authorise vendor recognised by the company in its web portal.
- Logistic Partner: Logistic partner means and include such partner of the company which facilitate and transfer the goods to the buyer.
- Tax: Tax means and include taxes applicable in India as well as the country where the goods is delivered.
- Goods: Goods means and include articles or items uploaded in the web portal of the company.
- Return: Return means the product which ought to be returned by the buyer to the company, for the reason of substantial defect or due to incorrect goods being delivered.
- Refund: Refund of goods as agreed in the instant terms and condition between the buyer and company.
- Dispute: Dispute means and include any legal dispute arising out of defective goods or refund of money between the buyer and company.
Website
1. Net price of the goods
Net price of the goods means actual price of the goods including GST and other local taxes of India.
2. Actual Price of the goods
Actual Price of the goods means and includes net price of goods and the logistic expenses as may be applicable over the product.
3. Addressee country
Addressee country means a country where the customer ordered the goods/articles to be delivered.
4. Returnable goods
Returnable goods shall means goods which are materially different from the goods/article listed in the website of the company or physically damaged article at the time of delivery.
5. Delivery Timeline
The company undertakes to make all effort for the delivery of goods within a period of 15 days from the date of payment of the actual price of the articles/goods.
6. Mechanism for placing orders
Customer/buyer intending to place an order from the website of the company shall select a product or products and pays the actual Price of the goods which shall be inclusive of the logistic expenses within a period of 48 hours days from the date of generation of the link for payment of the actual price of the goods.
7. Taxes & Import Duties
Taxes means and include taxes payable in India over the goods listed over the goods or articles at the website of the company. It shall also include taxes as may be payable by the customer upon the goods are requested to be delivered.
8. Return
Company undertakes to receive the return request of the returnable goods within a period of 3 days from the date of delivery of the goods to customer.
9. Refund Policy
The company undertakes to initiate the refund of the money to its customer or buyer within a period of 5 working days from the date of return of the goods subject to the approval by the company.
The company shall return the money in the bank account of the buyer as may be provided at the time of refund request by the buyer.
10. Final Pricing
The company undertakes to list the net price of the articles or goods in its website. The actual price of the goods or articles shall include the local taxes, logistic expenses as the case maybe. The buyer undertakes to pay the cumulative price of the goods which shall include net price of an article, logistic expenses, taxes payable over an article in India as well as custom duty and local taxes of the Country where the addressee resides or the goods is required to be delivered as the case maybe.
11. Video Management System
Where the buyer is willing to return the product to the company, he/she upload clear and legible videography of the article intended to be returned by the buyer in the portal of the company as the case may be sent to the email ID of the company i.e contact@setustore.com.
12. Dispute Redressal
The Customer/buyer voluntarily consents to refer any dispute arising out of any commercial transaction in the instant terms of the agreement by arbitration. The Customer/buyer consent to resolve its dispute through Arbitration proceeding. The Customer/buyer consent the place of Arbitration Proceeding to be Noida, Uttar Pradesh-India. The law applicable over the dispute shall be Arbitration & Conciliation Act 1996. The customer agrees Noida, U.P. India as a place of arbitration having an exclusive jurisdiction over of the dispute.

14. Changes to These Terms
Setu Store may update or amend these Buyer Terms from time to time. Updated terms will be posted on this page with a revised Last updated date. Continued use of Setu Store after posting constitutes acceptance of the amended terms.
